Amazon’s 2024 counterclaim
In GOLO, LLC v. Amazon.com, Inc. et al., C.A. No. 23-1200 (D. Del.), Amazon added a counterclaim under the Delaware Deceptive Trade Practices Act on October 23, 2024.
Amazon alleged that GOLO falsely advertised the health benefits and scientific efficacy of its products. The federal court’s opinion describes allegations about statements that products were clinically proven to provide weight-loss, nutritional, and disease-preventative benefits.
The June 5, 2025 ruling
The U.S. District Court for the District of Delaware dismissed Amazon’s counterclaim for lack of subject-matter jurisdiction. The court found that the counterclaim and GOLO’s claims did not share a common nucleus of operative fact. The court also stated that Amazon was free to pursue the counterclaim in state court.
